End User License Agreement (EULA)

PLEASE READ THIS END USER LICENSE AGREEMENT (“AGREEMENT”) CAREFULLY BEFORE USING ANY SOFTWARE DEVELOPED BY C-SAÚDE (hereinafter referred to as “SOFTWARE”). BY INSTALLING, COPYING, OR OTHERWISE USING THIS SOFTWARE, YOU AGREE TO BE BOUND BY THE TERMS OF THIS AGREEMENT.
1. GRANTING OF LICENSE
The Associação Centro pela Saúde Global (hereinafter referred to as C-Saúde) grants the User a limited, non-exclusive, non-transferable and revocable license to use the Software exclusively for personal purposes or for the purpose of carrying out activities linked to an organization and in accordance with this AGREEMENT, on a single device that is controlled and owned by you.
2. RESTRICTIONS
The User may not:
• Modify, adapt, translate, or create derivative works of the Software;
• Reverse engineer, decompile, decipher, or disassemble the Software, except in cases authorized by C-Saúde and as permitted by applicable law;
• Rent, lease, distribute, or sell copies of the Software to third parties;
• Use the Software in any revenue-generating activity, commercial enterprise, or for any use for which the Software was not designed.
• Use the Software to generate automated queries to any website or send any unsolicited email.
• Remove or alter any copyright, trademark, or other proprietary notices.
• Violate any applicable laws, rules, or regulations in connection with the use of the Software.
By using this Software, the User agrees that if any of the restrictions indicated above are violated, or if the intellectual property of third parties is violated, they will be held criminally liable.
3. DATA PROTECTION AND PRIVACY
The Software may collect, process, or store health information or personal data. C-Saúde undertakes to adopt appropriate technical and organizational measures to protect the privacy and security of this data in compliance with applicable data protection laws. Using the Software implies acceptance of C-Saúde’s Privacy Policy, which details how data will be collected, used, and protected.
4. USER OBLIGATIONS
The User is responsible for ensuring that any data entered into the Software is treated in accordance with applicable health privacy regulations. If the Software is used in a business or clinical environment, it is the User’s responsibility to ensure compliance with applicable data protection regulations, including, but not limited to, the secure use of personal and health data.
5. LIMITATIONS OF RESPONSIBILITY
C-Saúde will not be liable for any damages, including, but not limited to, direct, indirect, incidental, special, or consequential damages, arising from the use of or inability to use the Software.
Internet access is required to use this Software; therefore, C-Saúde is not responsible for the amount of data consumed when using this application.
6. TERMINATION
C-Saúde may terminate this AGREEMENT at any time if the User fails to comply with any of the terms. Upon termination, all copies of the Software must be destroyed.
7. UPDATES AND SUPPORT
C-Saúde may provide updates or corrections to the Software at its sole discretion but is under no obligation to do so. Any updates provided will be considered part of the Software and will be subject to the terms of this AGREEMENT.
8. APLICABLE LEGISLATION
This AGREEMENT shall be governed by the laws of the Republic of Mozambique. Any disputes arising from it shall be resolved exclusively in the courts of Maputo, with express waiver of any other.
9. FULL AGREEMENT
This AGREEMENT supersedes any prior or contemporaneous understandings, discussions, promises, communications, representations, warranties or advertising between the User and C-Saúde regarding the Software and therefore constitutes the full agreement between both.
By using the Software, the User acknowledges they have read and understood this AGREEMENT and are bound by its terms.
